Please take the time to read the contents of this page to make sure you fully understand and accept Art by Kelly’s purchase arrangements before placing an order. The terms and conditions are applied to the commercial relationship between you, the customer and Art by Kelly.co.uk and your use of the website.

1. All copyrights remain the property of Art by Kelly; the artworks title of ownership will be transferred to you, the customer, upon purchase, however, the reproduction of purchased artwork, including photographs (except photographs for limited private use) is not permitted.
2. As you are purchasing a unique piece of art it cannot be guaranteed that the work is still available, therefore availability is checked before payment is processed.
3. Art by Kelly uses the secure server of PayPal to process any monetary transactions.
4. Art by Kelly via PayPal must validate the credit card / cheque details submitted by the customer before any order can be processed. Once these details are validated Art by Kelly will confirm that the order has been accepted via e - mail. Cheques must be made payable to Miss Kelly Bajic.
5. All prices are in pounds sterling and include p&p, unless otherwise specified.
6. Delivery will be made by a reputable carriage company to the delivery address specified by you, the customer at time of order. All items will be insured during transit to cover damage and non – delivery.
7. Delivery of works are normally made within 10 – 14 working days from the date the order is processed, however Art By Kelly is not liable for any delay in the delivery of the work however caused. Time for delivery is not the essence of the Contract.
8. In the unlikely event that you are dissatisfied with any purchase from Art by Kelly a full refund will be given, less the delivery and bank costs. You must however notify and return the work within 10 days of receipt. The returned work must be in its original condition and insured during transit.
9. On delivery the Customer must immediately check the package and the art work for any damage before accepting the package from the delivery company. If the art work itself appears to be damaged, the Customer must immediately report this to the delivery company official and notify Art by Kelly accordingly within 24 hours.
10. All work is unframed unless otherwise specified. Art work can be framed upon request for additional cost.
11. Electronic pictures cannot perfectly represent original work; although great care and precision has been taken to represent the works of art as close as possible to the original, works of art purchased from Art by Kelly may be subject to minor colour variations to the on screen photographs. Art by Kelly is not liable for this and similarly cannot be responsible for the durability of any work.
12. The nature of original art means that the work remains individual and unique, thus please note there may be evidence of craftsmanship. Art by Kelly is not liable for this.
13. Authenticity is guaranteed by signature.
